We are pleased to inform that on 22th of March 2019 Advocate PhD Artur Rycak gave an interview on TV.RP concerning new draft provisions on the basis of which labour courts will be able to order employers to continue the employment of employees for the duration of proceedings until its termination.
The draft regulations indicate that:
- an employee will have the right to apply for a decision issued by a labour court in the mode of providing a security which orders further employment of an employee until the termination of the proceedings,
- in a judgment in which a labour court restores an employee to work or decides on ineffective dismissal, the court may order further employment of the employee until the case ends, i.e. until the case is heard by the court of second instance.
