Today I had the pleasure of giving an interview to Mr. Mateusz Rzemek in the program “Rzecz o Prawie” on TV.RP Dziennik Rzeczpospolita. I talked about the plan to establish November 12, 2018 as a holiday day and its consequences for employers, but above all that I talked about the REMUNERATIONS REGULATIONS (mistake in the title of the interview) and the effects of the Constitutional Tribunal's ruling of October 2, 2018 (26/15). In the ruling the Constitutional Tribunal found the provisions of the Labor Code and the Trade Union Act stipulating that the employer can not change or repeal the remuneration regulations independently if the only trade union organization operating in the establishment does not agree to such changes or if several trade union organizations jointly and they unanimously disagree on such changes ( If there is a difference of opinion between the trade unions, the employer can change the regulations by himself - we wrote about it in the Labor Law Monitor 11/2015 (published by CHBeck)
